The purchase or sale of real estate is often the largest
financial transaction in our lifetime. It involves
many complex legal issues beyond the scope of real estate
agents and title companies, such as estate planning, tax
issues and homestead laws.
In these current economic conditions it
is critical that you have a competent attorney to advise you
and protect your interests, especially if a “short sale” or
foreclosure is involved.
Title companies represent the insurance
company insuring the marketability of legal title to the
property subject to the “exceptions” and “exclusions” noted
in the title insurance policy, which can have a negative
effect on your legal rights and lawful use of the property.
In many cases exceptions and exclusions can be removed or
explained if they can’t be removed. We can advise you
of potential problems revealed by the title commitment or
title policy as well as effectively negotiate disputed to
obtain the best possible resolution. However, if a
resolution is not an option, we can vigorously pursue claims
to preserve our clients rights.
